Do I need a lawyer when selling real estate?
Retaining a lawyer to represent you in selling real estate can avoid years of headache and costs – lawyers protect you throughout the selling process, including reviewing, drafting and negotiating documentation; ensuring that any legal issues are cleared up prior to closing; and many other duties necessary to ensure a proper and timely closing.
In recognition of the demands and complexities of real estate transactions, some states require that a lawyer be involved in all real estate transactions, while other states do not. Massachusetts requires the involvement of a lawyer in all real estate transactions under Massachusetts General Laws Chapter 221 §46a.
For states that do not require a lawyer to be involved in all real estate transactions, some still require lawyers to engage in certain aspects or stages of a transaction, such as being present at closing. Connecticut is an example of a state not requiring a lawyer for every real estate transaction. In Connecticut, lawyers are legally required to be engaged for buying and selling real estate if title insurance is involved. Similarly, only lawyers can draft the certain transaction documents. Similarly, Rhode Island requires lawyers to conduct title examinations, draft documents, and other important aspects of a real estate transaction deemed “practice of law”. In a practical sense, buying and selling real estate in Connecticut and Rhode Island requires the involvement of an attorney.
