Real Estate Law Services for Sellers in Rhode Island, Connecticut and Massachusetts

For most real estate owners, hiring a sellers’ attorney is one of the best investments that they can make. When selling a property, there are many documents that need to be drafted, negotiated and executed. Names, dates, and property specifics, among other details, need to be consistent across all documents. An issue in any of the documents can hold up the sale, or worse, can potentially render the sale invalid if not caught prior to closing. To help alleviate much of this concern, and to ensure that your interests are fully protected, retaining an experienced real estate lawyer with law services for sellers can save you hours of headache and tens of thousands of dollars.

At PALUMBO LAW, our lawyers are experts in real estate transactions, having helped hundreds of individuals, families and investors throughout Rhode Island, Massachusetts and Connecticut buy and sell real estate in an efficient and painless process. We are highly specialized in real estate law – we are not general practice lawyers dabbling in real estate. We give each real estate transaction the legal expertise and individual attention that it requires. Through our highly-skilled and hand-selected team of real estate legal professionals, we offer a streamlined service for real estate sellers. Our attorneys regularly receive industry recognition for outstanding legal practice and our clients agree. Do I need a lawyer when selling real estate?

Retaining a lawyer to represent you in selling real estate can avoid years of headache and costs – lawyers protect you throughout the selling process, including reviewing, drafting and negotiating documentation; ensuring that any legal issues are cleared up prior to closing; and many other duties necessary to ensure a proper and timely closing.

In recognition of the demands and complexities of real estate transactions, some states require that a lawyer be involved in all real estate transactions, while other states do not. Massachusetts requires the involvement of a lawyer in all real estate transactions under Massachusetts General Laws Chapter 221 §46a.

For states that do not require a lawyer to be involved in all real estate transactions, some still require lawyers to engage in certain aspects or stages of a transaction, such as being present at closing. Connecticut is an example of a state not requiring a lawyer for every real estate transaction. In Connecticut, lawyers are legally required to be engaged for buying and selling real estate if title insurance is involved. Similarly, only lawyers can draft the certain transaction documents. Similarly, Rhode Island requires lawyers to conduct title examinations, draft documents, and other important aspects of a real estate transaction deemed “practice of law”. In a practical sense, buying and selling real estate in Connecticut and Rhode Island requires the involvement of an attorney.
